Overview

Calm advice when your family circumstances change.

Separation is personal and stressful, and most people are worried about three things: their children, their home and how much of what they have built they will keep. Joshi Lawyers gives calm, clear and practical advice so you understand your options and can make the next decision with confidence.

We act for separating spouses and parents, usually with a business, a trust, investment property or superannuation in the pool, from a single home to multi-entity structures worth well over $10 million. From the first meeting you know where you stand: what a fair outcome looks like, how we propose to reach it, and what the other side is likely to do.

Nine in ten of our family matters resolve without a final hearing, most by negotiation, mediation or consent orders, and most property settlements are finalised within six to twelve months of the first meeting. Where court is necessary, we prepare every matter so that you are the best-prepared party in the room.

Our family law experience includes:

  • Separation and divorce
  • Parenting arrangements, parenting plans and consent orders
  • Property settlements, including businesses, companies and trust structures
  • Binding financial agreements before, during or after a relationship
  • Spousal maintenance and child support
  • De facto and same-sex relationships
  • Family violence and intervention orders
  • Negotiation, mediation and representation in family law proceedings

If you are in danger, call 000. For confidential family violence support, call 1800RESPECT on 1800 737 732. Use the Quick exit button to leave this site immediately.

Questions

Frequently asked questions

Answers to the questions we are asked most often about family law, fees and how a matter runs.

  • How soon after separating should I get advice?

As early as you can. Early advice protects your position, avoids common mistakes and keeps you inside time limits, including the 12-month limit after a divorce order to start property proceedings.

  • Do we have to go to court?

Usually not. Most of our family law matters settle through negotiation or mediation. We prepare every matter so that, if court becomes necessary, you are ready.

  • What does it cost?

The first meeting with a solicitor is a fixed fee, quoted when you book. After that you receive a written plan and estimate for each stage, and you are told before any estimate is exceeded.

  • How long will it take?

Most property settlements are finalised within six to twelve months of the first meeting, and parenting arrangements often sooner. Matters that go to a final hearing take longer, which is one reason we work to avoid it.

  • Will my matter stay private?

Yes. Family law matters are handled discreetly, and we never publish anything that could identify a client or a party to proceedings.
