Conveyancing onboarding

Tell us what the matter is and we ask only the questions it needs. It takes ten to fifteen minutes. At the end you pay an amount on account of costs, set as a share of our fixed fee for the matter. Our costs agreement follows by email for you to sign. If anything is unclear, leave it blank and we will follow up with you.

  1. 1 About the matter
  2. 2 Money on account
1 What do you need help with?
Choose the matter
Are you buying or selling?
Which side are you on?
2 Who we act for
Who is the client?

We will ask for the trust deed, the constitution or the company extract when we verify the entity. The person completing this form is the contact below.

Please enter your name exactly as it appears on your driver licence or passport, and as it appears on the title if different.

Are you an Australian citizen?

Foreign purchasers may need FIRB approval and pay additional duty; we check this first.

Every vendor needs an ATO clearance certificate before settlement or the purchaser must withhold part of the price. We will tell you how to apply.

Is there a second person we act for on the title (another director or trustee who signs)?
3 Person 2 – their details
4 About your purchase

These answers affect stamp duty concessions and the documents we prepare.

Is this your first home in Australia? (Have any purchasers previously owned residential property in Australia?)
Will you live in the property as your main home within 12 months of settlement?
Are you borrowing from a bank or lender to fund the purchase?

A figure is fine; we confirm it from the contract.

4 About your sale

These answers go into the Section 32 statement and the contract, so please be as accurate as you can.

Is there a mortgage on the property?
Is the property part of an owners corporation (body corporate)?
Has any building work been done in the last 7 years (extensions, renovations, pool, deck, garage)?
4 About the property

Whether the price is plus GST, a going concern or under the margin scheme changes the contract and the money; we settle it before anything is signed.

Is more than one title, lot or contract involved?
Is the purchase financed by a lender?
4 About the business
4 About the lease
4 About the transfer
Is the lease being transferred with the sale of a business?
4 About the franchise

The Franchising Code gives you at least 14 days with the documents before you sign; tell us if you have been given less.

4 About the subdivision
Is there a mortgage on the land?

The lender must consent to the plan being registered; we arrange that.

4 About the caveat
What do you need?

A caveat lodged without a proper interest can make you liable for the owner’s losses, so we check this before lodging.

5 Anything else

For example special conditions, dates that matter, or questions for us.

Would you like to hear from Joshi Lawyers occasionally? (optional)

A few times a year we send a short note on things that affect property and business owners – changes to stamp duty, land tax, leasing law and the like. No sales pitches, no sharing your details with anyone else, and you can unsubscribe with one click at any time. Choosing “No” has no effect on your matter.

Nothing is sent to us until the money on account is paid. We verify your identity separately; please do not attach documents here.
